The problem is actually very simple to explain. Most work places these days have a No Smoking policy and so a company owned vehicle being driven by an employee is the same as a machine minder feeding parts to a machine. Both are in company space.
In Scotland there have been cases when owner/operators, who have been awaiting their partners to assist with shopping and take them home, have been arrested for sitting, off the meter, having a cigarette. They fought the cases saying that the driver was on his social time and could therefore smoke as social car drivers can do.. They lost, as the taxi was deemed to be a place of work or possible work in the near future!!
