Football hooligans free to cross border after legal loophole is revealed

Football hooligans free to cross border after legal loophole is revealed - The Daily Record

Scotland and the rest of the UK have different legal systems I am glad to say. A nice example being.........

If you live in Scotland and an English Firm gave you credit or a credit card on which you default, then the English firm must try to get their money from you. If that fails then the English firm must instruct an English lawyer who must then instruct a Scottish lawyer to take you to Court for recovery or poinding of assets for resale by Sheriff's officers if no payment plan can be agreed or a payment plan has failed.
This is a very costly business as M'Learned friends like a good earner!!
After going through all of this procedure they may still get nothing at all and most companies just don't bother. Instead they "sell" bundles of debt to Collection agents for a percentage of the debt owed. eg. U owe £500 This debt may be sold for £50 and the debt would now be "owned" by the collection firms. If they can get you to pay up they can get the full £500 for a payment of £50 or less sometimes!! They are in the same position as the original firm in that they too must instruct in England and then in Scotland. They are the people who phone you up by using auto dialling computer calls up to three times a day in some cases!!!
They cannot send Bailiffs, they can't operate in Scotland, they cannot take you to Court in England and Scottish Sheriff's Officers cannot do anything until the full Court process has been gone through. If one of these companies starts asking you questions like "do U have a mobile phone?" "Do you have assets?" You can politely refuse to answer them. Should they continually call the firm can be charged with harassment.
If on the off chance that the whole rigmaroll has been gone through a person may declare themselves Bankrupt and nobody gets anything from you at all !!!
