Revealed: thousands prosecuted under controversial law of joint enterprise



Under English Law, a person or persons can be charged with murder, just for being there at the incident. Example.......two gangs are fighting in a park.  One gang member kills an opposing gang member. In England,all members of the killer's gang can be charged with,probably, manslaughter, even though only one person did the deed.

Example...Three people go to rough someone up over a debt. One of them,unknown to the other two,has a grudge against the debtor and uses this visit to kill the person. All three can be charged with murder.

The Steven Lawrence racial killing would be one real example. The last male, hanged in England,Derek Bentley, was involved in a shooting of a policeman, by a person that he was with, during a break in robbery. He had no gun.

This does not happen under Scottish Law.
