Yes I understand the problems............if joe sixpack clears a path of snow which then freezes causing a person to fall and smash a hip...........who do they sue???
In this instance, joe as he did it voluntarily However,if neighbours offer to buy joe a sixpack for doing the work, then they can be sued as main contractor The beer is termed as being benefit in kind and therefore payment to joe who can also be sued too! If they give joe the sixpack after the event is completed,as a gratuity,then there has been no contract and joe can be sued.
Now in the Council,whose remit includes safe pavements,come along and their employees do the work then the Council can be sued. If they contract the work they can still be sued as main contractor. They in turn may sue their contractor in England. Under Scottish Law everybody can be sued jointly and severally
