In Law,the data belongs to the phone company and so they can do what they like with it. Police would just apply for a warrant to get the data, if they really wanted it, so the phone companies just give it out.

The best way to pass information is to use the draft scion of E mail. One person puts a message or video into draft and then passes on the password.  Anyone with the password, may enter draft and read or view the content. Then they can answer 'received' or add more to it.  As the draft has never been sent out it cannot be captured. A draft can be deleted and not found on a hard drive.
