The excuse here is that they did not see the tram coming in the darkness.  Then how did the driver see??  Even if out of service,with the internal lights off,there must have been lights on at the front of the tram to watch for obstacles on the track.
I can't believe any of these accident stories are anything else but the person injured or killed own fault, for either not looking or disobeying warnings, barriers or lights.
