Teachers ,especially, but Scout and Guide leaders, in short , anyone in charge of a group is responsible for that group's safety. If the group leader does not have insurance then his employer should do. However, insurance companies will only pay out if certain rules are followed. If not then there is no, or reduced, compensation.
An action, for Civil damages would then probably be taken against the employer of the group leader or their umbrella organisation such as the Scouts. This is the case in England, Wales and Northern Ireland. However in Scotland both the group leader and the company/organisation may be sued jointly and severally for the same action.So they really should follow the rules. In my opinion they were right to sack this guy and he has little hope, to my mind, of winning at any Tribunal.
